Refund and Returns Policy

This document sets out the terms and conditions of the Warranty (‘Warranty’) provided by www.eggchairoutlet.com.au (‘we’, ‘us’, ‘our’) for the Products.

AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.   You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

DEFINITIONS:

‘Failure’ refers to an unexpected breakdown of the Product due to a mechanical or electrical fault. It does not include issues caused by normal wear and tear or those specified in the ‘What’s excluded’ section of these Terms and Conditions. ‘Manufacturer’ indicates the entity that produces the Product. For clarity, we act as the importer and reseller, not the manufacturer. ‘Manufacturer’s Warranty’ denotes the optional warranty for parts and/or labour provided by the Product’s manufacturer. ‘Original Purchase Price’ is the amount you paid us for the Product, as indicated on your original purchase receipt or tax invoice (excluding any discounts, cashback offers, or other applicable price reductions not shown on the receipt or tax invoice). ‘Product’ refers to the hanging chairs, egg chairs, mats, protective covers, and other items sold on this website, which we import into Australia and sell to you. ‘Terms and Conditions’ are these terms and conditions governing this Warranty. ‘Warranty’ refers to the warranty applicable to the Product as outlined in these Terms and Conditions.

WARRANTY ELIGIBILITY

To qualify for this Warranty, the Product must meet the following criteria:

  • It must be a new purchase.
  • It should come with a valid Manufacturer’s Warranty for Australia at the time of purchase.

The Warranty period is outlined on your purchase receipt and begins the day after the Manufacturer’s Warranty expires, unless you decide to cancel it earlier. This Warranty will be in effect for 12 months from your purchase date of the Product.

NOT INCLUDED:

This Warranty does not cover any of the following:

  • Any faults that were disclosed to you prior to your purchase.
  • Issues arising from:
    • Negligence, accidental or intentional misuse, or unauthorized modifications (unless these were made by us).
    • Failure to adhere to the manufacturer’s guidelines for use, operation, cleaning, or maintenance.
    • External factors, including actions by third parties, electrical interference, or the use of aftermarket accessories.
    • Infestations by pests or vermin.
    • Natural disasters or human-made catastrophes.
    • Water damage, rust, or corrosion.

Additionally, the Warranty does not cover:

  • Repairs related to cosmetic elements of the Product, such as decals or finishes, which do not impact its functionality.
  • Accessories used with the Product unless those accessories have their own Warranty.
  • Replacement costs for consumable items needed for the Product, like batteries.
  • Any repairs or replacements of tyres for any reason.
  • Loss, damage, or expenses resulting from:
    • Software or data loss caused by a Product Failure.
    • Damage caused by batteries or other consumables, whether internal or external.
    • Tyre punctures or wear.
    • Using the Product for purposes other than personal, domestic, or household use.
    • Inability to use the Product following a Failure.
  • Transportation, installation, or removal costs for the Product or any replacement product provided by us. Note that if your refund or replacement is approved, it does not cover the shipping costs you incurred to return the item.
  • Any loss, damage, or costs where no Failure is identified.
  • Claims made against you by third parties for nuisance or breaches of environmental regulations.
  • Regular maintenance costs, such as cleaning, lubrication, or external adjustments.
  • The Product if it has been recalled by the manufacturer or a government body.
  • Claims from third parties, including for personal injury or property damage.
  • Minor imperfections in the Product’s finish due to manufacturing or slight damages incurred during transport.
  • Any claims you may have for personal injury or property damage.

CHANGE OF MIND

We will not provide a refund or replacement if you change your mind.

FALSE OR EXAGGERATED CLAIMS

We reserve the right to deny a claim under this Warranty or reduce the benefits provided if, in our reasonable judgment, you make any misrepresentation or engage in any fraudulent or dishonest actions related to the claim.

HOW TO MAKE A WARRANTY CLAIM

To initiate a claim under this Warranty, please follow these steps:

  1. Email us at [email protected], providing details of the Failure.
  2. After receiving our acknowledgment, arrange to send the Product or faulty part back to us (unless we advise otherwise).

We will send you a return authorization code via email. Please include this code on the packaging of the returned items to help us identify your return easily.

Once the item is received at our warehouse, we will process your refund or replacement within 5-7 working days. Please note that the refund amount is limited to the price you paid for the Product and does not include any shipping costs incurred when returning the item. The Warranty also does not cover any freight charges paid at the time of your original order.
